A Living Archive of the Counterlawfare Institute

The Russiagate investigation remains the preeminent modern case study in lawfare, the strategic abuse of legal systems and institutional processes to achieve political outcomes.

The Counterlawfare Institute has curated this repository to document how a political smear campaign was transformed into a years-long government-backed operation that leveraged the powers of law enforcement, intelligence agencies, and the courts to legitimize a narrative that was known from the outset to be unsupported by evidence.

This archive is intended as a living historical record. It will continue to expand as new documents are declassified, released through litigation, uncovered through investigative reporting, or otherwise brought into the public domain.

Genesis: The Foundations of the Narrative

The documents in this section capture the inception of the Russiagate narrative, tracing it back to its origins as a calculated political strategy rather than an intelligence-led inquiry. These records demonstrate that the highest levels of the federal government were, at the earliest stages, in possession of intelligence regarding the Clinton campaign’s orchestration of the collusion fabrication. Taken together, these entries provide the critical evidence required to reframe the investigation not as an inquiry into foreign influence, but as the institutionalization of a domestic political smear.

The Podesta "Swift Boat" Email: The Earliest Documented Plan to Smear
Date: February 26, 2016
This email serves as the earliest documented record of the political strategy that would eventually evolve into the Russiagate narrative. In this correspondence, members of the Clinton campaign discuss a "Swift boat" project targeting Donald Trump, marking the initial conceptualization of the smear campaign that would later be laundered through the federal justice system. This document establishes the intent that predates the formal intelligence-led investigations by several months.

FBI Electronic Communication Opening "Crossfire Hurricane"
Date: July 31, 2016 (Declassified and released: May 20, 2020)
This document marks the official launch of the investigation into the Trump campaign. Its proximity to the July 2016 intelligence briefings, which alerted the Obama administration to the Clinton campaign's strategy to smear their opponent, reveals a troubling convergence of events. While the FBI claims that a tip from Australian diplomat Alexander Downer was the investigation's starting point, the strategic alignment between the Clinton campaign's stated goals and the subsequent actions of the federal government suggests that the narrative of "Russian collusion" was not discovered, but rather facilitated, by an apparatus already fully aware of its political roots.

    This document release provides internal visibility into the FBI’s investigative environment during the transition to the Trump administration. The files confirm that after the FBI became aware of the political origins of the Trump-Russia collusion narrative, as well as the fact that the dossier primary sub-source Igor Danchenko disavowed the dossier, they continued to provide briefings to the Department of Justice and Congress that obscured these facts. The FBI’s calculated choice was to maintain the appearance of a credible investigation to oversight bodies, despite having cataloged evidence internally that the foundation of the case was a partisan political hit job.

FBI Investigation of President Trump as a Possible Russian Agent

The documents below comprise FBI records released in 2026 from the investigation codenamed OXFERD C0MMA, a full counterintelligence investigation opened on May 16, 2017 to determine whether President Donald J. Trump was or had been acting, knowingly or unknowingly, for or in coordination with the Russian government. The investigation was classified as a Sensitive Investigative Matter and was subsequently transferred to personnel working for Special Counsel Robert Mueller.

Notably, the codename appears to have been deliberately distorted in two separate ways, with "Oxford" rendered as "Oxferd" and the letter O in "Comma" replaced by the numeral 0, producing "OXFERD C0MMA." Those alterations would have frustrated ordinary keyword searches for "Oxford Comma," including FOIA searches and other attempts to identify records associated with the investigation. While the documents do not themselves establish why the codename was constructed this way, its practical effect was to make the investigation substantially harder to locate through conventional searches.

FBI Opening Electronic Communication: Oxferd C0mma Investigation of President Donald J. Trump
Date: May 16, 2017 (Declassified: July 30, 2026)
This six-page Electronic Communication formally opens the FBI's OXFERD C0MMA investigation into President Trump. The document states that the FBI had an "articulable factual basis" to investigate whether the President was or had been involved in activities for or on behalf of the Russian government, and identifies the investigation's goal as determining whether Trump was "directed by, controlled by, and/or coordinated activities with" the Russian Federation. It also sets out the FBI's purported predicate for opening the investigation, including Crossfire Hurricane information, the Republican platform debate over Ukraine, Trump's business connections to Russia, his interactions with FBI Director James Comey, and Comey's firing.

This Electronic Communication memorializes the FBI's notification to the Department of Justice that it had opened the OXFERD C0MMA investigation. It records that Acting FBI Director Andrew McCabe personally informed Deputy Attorney General Rod Rosenstein on May 16, 2017 that the FBI had opened the full investigation into President Trump.

FBI Closing Electronic Communication: Oxferd C0mma Investigation

This closing communication provides the FBI's retrospective account of the OXFERD C0MMA investigation, including its predicate, scope, transfer to the Special Counsel's Office, investigative activity, and ultimate disposition. The document confirms that the FBI opened the full investigation into President Trump on May 16, 2017, transferred responsibility for it to FBI personnel assisting Special Counsel Robert Mueller after his appointment, and ultimately closed the case administratively following delivery of the Special Counsel's report in March 2019.
